Denver car accident attorney If you are involved in a car accident with one other vehicle, establishing fault is usually a matter of deciding if you or the other driver is to blame for the accident. Occasionally, there may be a third party responsible, such as a government entity or construction road crew. When the accident involves multiple vehicles, however, establishing fault can become increasingly difficult. Multi-vehicle crashes or pileups usually result from a chain reaction. In most multi-vehicle accidents, there may be multiple parties to blame for different components of the accident. You yourself may share some of the blame for the accident or for a portion of the pileup. With so many differing points of view, it can be difficult to establish negligence and know which insurance company to contact. To make matters worse, insurance companies understand these complications and are usually reluctant to reach settlements until the chain of negligence is fully established. To further complicate matters, passengers in varying vehicles may be seeking compensation from all parties responsible or from the driver of the very vehicle they were riding in. As such, you may find yourself seeking compensation from other drivers’ insurance companies and defending yourself from lawsuits at the same time. The complexities that surround multi-vehicle crashes are endless and require a law firm with the resources to fight aggressively for your rights. Insurance companies do not usually reach settlements quickly when there are multiple parties involved and everyone begins pointing fingers at everyone else, in an attempt to reduce their own liabilities. When significant injuries or deaths are involved, the complications become even greater, with much more at stake. Injured accident victims or families who have lost a loved one will need money for medical expenses, lost wages, lost future earnings, pain and suffering, and more. Choosing a lawyer who understands the complications that can arise in a multi-vehicle crash is important to obtaining the compensation you need—and deserve. denver personal injury attorneyCar and motorcycle accidents often occur at lightening speeds and with little warning. The impact from those crashes can leave victims with crushed and broken hands, arms, legs, and feet. While orthopedic surgeons and physicians are usually able repair the majority of broken bones and limbs, there are times when complications and even infections can interfere with the healing process. When this occurs, it may be necessary to remove the injured extremity in an attempt to save the accident victim’s life. After an amputation, accident victims will need to relearn even basic skills, such as walking, driving, or even dressing themselves. In addition, they may be unable to continue in their chosen profession, and be forced to find new lines of employment. It is important to understand the true costs of limb loss before you agree to a settlement. These costs are not always apparent and future expenses, such as prosthetic devices, must be taken into account. A study conducted by John Hopkins Center for Injury Research and Policy found that the total lifetime costs of amputation was well over a half million dollars. This included costs such as hospitalizations, prosthetics, rehabilitation, therapies, outpatient doctor visits, and pain medications. It did not, however, take into account lost wages, loss of future earnings, or pain and suffering. Prosthetic Devices are Expensive If you have suffered the loss of a limb, you will need to be fitted for a prosthetic. These artificial hands, arms, and legs can be costly and cost between $5,000 and $50,000 depending on their design and material. In addition, being fitted for a prosthetic means additional rehabilitation to learn how to use the new device. It is important to know that these costs are not a one time only cost either. Prosthetic devices are usually changed out every 3-5 years, and this ongoing cost must be taken into account before reaching an appropriate settlement. On nearly every highway and Interstate in Colorado, you will see a large commercial truck. These trucks go by several names, including big rigs, semi-trucks, 18-wheelers, tractor-trailers, and semis. They are found hauling livestock, hazardous chemicals, and produce, and Colorado is a popular destination. These large commercial trucks are 20x the size and weight of the average car on the road, so when disaster strikes, motor vehicle occupants usually suffer severe and often fatal injuries. While there are unique circumstances surrounding each trucking accident, the majority of trucking accidents are caused by:
  • Truck driver error: According to the Federal Motor Carrier Safety Administration (FMSCA), truck driver error is the cause of the majority of trucking accidents. Truck drivers may drive under the influence of drugs or alcohol, drive fatigued, or drive distracted. They may be inexperienced or improperly trained, which could lead to mistakes in handling these large vehicles on the road.
  • Truck equipment failure: Trucking companies are supposed to maintain and inspect their vehicles on a regular basis to ensure that they are safe to operate. Defective tires, failing brakes, or faulty steering components can all lead to devastating accidents.
  • Weather conditions: Poor weather and large commercial trucks generally do not mix. Snow, ice, and rain can make for slippery road surfaces that can be difficult for large trucks to drive on. These trucks are not able to stop as quickly as other vehicles, making bad weather even more risky. When a truck driver does not account for bad weather conditions, trucking accidents occur more frequently.
  • Trucking company negligence: a trucking company has a responsibility to ensure the safety of all those on America’s roads by following the FMCSA trucking rules and regulations. This includes properly maintaining their trucks, not overloading trucks, and making sure that their drivers get frequent rest and adequate sleep. When a trucking company fails to do this, they put everyone in jeopardy. Falsifying driver logs, encouraging drivers to drive longer hours, and failing to fix or repair trucks promptly are all examples of trucking company negligence that could lead to a devastating Denver trucking accident.

If you or a loved one has been injured in a Denver trucking accident, you may be wondering what steps to take next. Is there anything I can do to get compensation for lost time at work or money spent out of pocket for medical expenses? Can I file a lawsuit against the trucking company for negligence? Sometimes, in truck accidents, the negligence of the trucking company that employs the truck driver or owns the truck may be a contributing factor in the accident. When this happens, injured parties may be eligible to receive compensation for their injuries, medical bills, property damage, lost wages and mental anguish by filing a truck accident lawsuit against the negligent trucking company. Some specific examples of trucking company negligence may include; Failure to conduct background checks on drivers before allowing them on the roadways Failure to properly maintain trucks Establishment of unrealistic driver schedules When trucking companies fail to perform adequate background checks on drivers, neglect their responsibility to maintain their trucking fleet, or place profit before safety by placing unrealistic expectations on their drivers, they are neglecting their obligation to public safety and should be held accountable for the harm they cause. Truck accidents in Denver are different than other vehicle accidents because of the federal laws that govern the trucking industry, and an experienced Denver trucking accident attorney will know exactly where to begin. There are several things that need to happen immediately to help build the best case possible for you, the victim. It is imperative that all evidence is preserved and witnesses are interviewed. Accident reconstruction specialists may be needed to inspect the crash vehicles and look for evidence of the impact and any defective parts. It is important to understand that investigating a truck accident can be very expensive. A qualified Denver truck accident lawyer will have the resources to investigate and win your case for compensation of personal injury or wrongful death. Truck accident lawsuits can also be complicated because in many cases, more than one insurance company is involved. It is the trucking company’s insurance company that will ultimately pay the truck accident victim and his or her family. If you have been involved in a truck accident in Denver, the trucking firm’s insurance company will most likely contact you. DO NOT speak with them, their goal is to make sure they pay out as little as possible. Instead, contact a law firm with experience handling truck accident lawsuits. Act quickly to preserve your rights. Police-lightsThe Aspen Post reports that a woman has filed a civil claim against the Roaring Fork Transportation Authority as well as a bus driver following the death of her adult daughter in a public transportation accident. The daughter, who was walking in the bus lane in the early hours of the morning on New Years Day, was struck from behind by a bus, causing the windshield of the bus to shatter. The woman was dragged by the bus, and died as a result of the accident. The mother is seeking close to $500,000 in the claim, hoping to recover compensation for funeral expenses, loss of income, and loss of companionship. Have you or a loved one been injured in a public transportation accident? Contact an experienced Colorado public transportation accident attorney immediately; time is often of the essence. When filing a claim against a government agency such as a public transportation district, the statute of limitations is generally significantly shorter than it would be when filing a civil claim against a private person or company. For this reason, acting as quickly as possible to protect your rights is vital. While it is unusual for a government agency to be found responsible for injuring a person, when this does happen, you don’t want to lose your rights. JasonCam20111209 164Car accidents are a daily part of life in Colorado, with millions of car accidents occurring annually across the country. Understandably, many people get nervous when they are involved in a car accident. Knowing what to do after a car accident can be difficult in the best of times, but when someone is injured, the police are involved, and people are getting emotional, it can be very difficult to know how to react, and doing the wrong thing by mistake can be very easy. When the an accident results in serious injuries, it is a good idea to speak with an experienced Denver car accident lawyer. Here are some frequently asked questions about Colorado car accident.

Q: If I am in a car accident, and the police come, should I talk to them?

A: Yes, you should speak to the police. There is no need to tell the police more than simply the facts of the accident. You should not say anything that indicates blame; don’t accept blame for the accident, and don’t accuse anyone else of fault in the accident. The accident reports that police officers take are not always accurate, but it is best not to give the police a reason to think badly of you, either by claiming responsibility or by blaming someone else. A dedicated Denver car accident lawyer can often conduct an independent investigation, and demonstrate the facts of the case, even if the police officer got them wrong.

Q: Do I have to tell my insurance company about my car accident?

A: Yes, you do need to notify your insurance company. When it comes to insurance, in many cases the less you say the better, particularly when it comes to the other driver’s insurance company. This is another example of why it is a good idea to speak with a Denver car accident lawyer who can help ensure that nothing that is said to the insurance company is twisted in order to be used against you.

Q: What should I do if the car insurance company won’t pay my claim?

A: Unfortunately, it is standard practice at some insurance companies to simply deny large claims in order to protect their own bottom line. The claim you filed after your car accident has been denied, or if they are offering you a settlement that you don’t believe will cover the cost of the accident, speak with a dedicated Denver car accident attorney to discuss your options. John Fuller can help you understand your rights, and ensure that you receive the full, fair value of your insurance claim.

The Denver Post reported an accident where an RTD Bus hit a pedestrian. The bus that hit him was the 15 Limited and was turning left from southbound Broadway onto East Colfax Ave. The eyewitness said that he was an arm’s reach away from the man when the accident happened. The witness said that the man had waited for a car in front of the bus to pass, then he stepped out in front of the on coming RTD Bus. The witness insisted that the pedestrian stepped out in front of the bus on purpose. The driver of the bus was shocked but not injured. The man was rushed to a hospital but no other details about his injuries have been released.

The National Highway Traffic Safety Administration reported that in 2010, over 4,000 pedestrians were killed in pedestrian-car collisions. Over 70,000 pedestrians were injured in 2010. This means that a pedestrian was killed every two hours and injured every eight minutes in traffic crashes in 2010. The most common time for pedestrian-car accidents to occur is during the nighttime, over 68% of pedestrian fatalities occurred at night. Most people are out enjoying the weather on nice days in Colorado. That coincidentally is when over 80% of pedestrian fatalities occurred. Almost three-fourths of pedestrian fatalities occurred in an urban setting versus a rural setting.  This means that the highest chance you have of being in a pedestrian-car accident is when in cities on a clear sunny day. It is important as a pedestrian to decrease your chances of being hit by obeying the pedestrian laws and crossing signals. However, children 15 and young accounted for 7% of the pedestrians killed by motor vehicles. As a driver it is important to always check for pedestrians in blind spots and in crosswalks. There were over 51,000 accidents that involved buses in 2005 according to National Transportation Statistics. The Federal Motor Carrier Safety Administration reported that commercial vehicles accidents accounted for nearly 5,000 fatalities in in 2006.

If you have been seriously injured in a pedestrian-car accident contacting Denver public transportation accident lawyer John Fuller can help you. A dedicated lawyer will ensure that you get the medical care you require and help you recover financial compensation. When you are a pedestrian you are exposed to more elements. Unlike the driver in a car, a pedestrian has less protection from a collision. If you have been injured in a pedestrian-car accident it is important to seek medical attention immediately, but also important to look for signs of injury well after the accident. Some injuries may not be immediately apparent. Contacting an accident lawyer will help ensure that all the medical care you require will be done and that your rights are protected. When involved in a public transportation accident the statute of limitations may be significantly shorter, meaning that you have less time to act. Seeking financial compensation for injuries after being hit by a car is important. The medical bills, lost wages, and the possibility of having life-altering injuries can cause a need to be financially compensated. uninsured drivers attorneyAccording to CBS News, a woman driving a Pontiac on I-70 in Aurora was killed after driving into the back end of a semi-truck. Police believe that the truck may have been having mechanical difficulties, and for that reason was driving very slowly in the lane of traffic. The woman came up behind the truck, and wedged her car underneath the back end of the trailer. She died at the scene. Investigators do not believe that drugs or alcohol were involved in the crash. accidents with government vehiclesAccording to CBS news, a garbage truck crashed into two other vehicles near Highway 287 and Arapahoe road shortly before 8:00 am during the morning commute. The State Patrol closed the road for several hours afterward to clear up and investigate the collision, which resulted in the tragic death of one person. There do not appear to have been any additional injuries.  The exact cause of the accident is unclear; hazmat crews were dispatched to the scene in case any hazardous substance leaked from the garbage truck.  There were some initial concerns that something may have been leaking, but there is no information as to whether this turned out to be the case. Have you lost a loved one in a commercial vehicle accident? Contact an experienced Denver trucking accident lawyer immediately. According to the Federal Motor Carrier Safety Administration, several thousand people are killed in accidents with large trucks every year. This number is not huge, compared to the number of accidents, but it is certainly far too big for the families who are left to grieve the loss of loved ones. In addition to the fatalities, there are tens of thousands of injuries, and tens of billions of dollars in property damage annually relating to commercial vehicle crashes. One of the difficulties of these accidents is that the commercial trucking companies have dedicated attorneys whose job is to protect the company’s bottom line. In the case of a traffic accident, this often means denying responsibility and paying out as little as possible in insurance claims. denver personal injury attorneyIf you have lost a loved one in a commercial trucking accident, speak with an experienced Denver trucking accident lawyer today to discuss your options. According to KDVR.com, Shawn Howell witnessed an accident this morning in which a trash collection truck rolled over onto a Jeep, causing significant damage to both the truck and the Jeep. Mr. Howell said that both vehicles were driving the same direction on Colorado when they came to another accident. In trying to avoid the other accident, the garbage truck rolled onto the Jeep. Shortly after the accident, an employee of Law Father who was on his way to work passed the accident site. He stopped to help, and took some pictures as workers returned the trash truck to its wheels. Have you or a loved one been injured in a commercial vehicle accident? Large trucks or buses are involved in 300,000 or more traffic accidents annually nationwide. The majority of these, including this morning’s wreck on Colorado Blvd, involve property damage only. Unfortunately, however, there are over 50,000 injury accidents involving large trucks and buses annually, with around 3,00 or more fatal crashes. It is very lucky that this particular crash was not one of them. Have you or a member of your family been involved in a trucking accident? Contact a dedicated Denver trucking accident attorney today.
