Woman on red bikeEveryone in America has a responsibility to share the road. This means motorists, bikers, cyclists, and pedestrians all have to learn to get along. Yet, each year thousands of bicyclists are injured and killed in motor vehicle accidents on the road. Motor vehicle drivers are quick to point the finger, citing lack of bicycle safety or riding in the middle of the lane. Bicyclists, on the other hand, are quick to point out that motor vehicle drivers don’t always pay attention to them in the road or cut them off when they have the legal right-of-way. So this begs the question: Who causes accidents more often: Cyclists or Motorcyclists?
denver personal injury attorney Spinal cord injuries are on the rise, due in large part to an increase in elderly accidents—particularly slip and falls. John Hopkins researchers studied over 43,000 adults who were treated for spinal cord injuries between 2007 and 2009. They found that elderly victims over the age of 65 experienced an increase in spinal cord injuries. In 2007, there were 79.4 injuries per million; in 2009, that number had climbed to 87.7. Over that same 3 year period, it was found that falls were the leading cause of these traumatic spinal cord injuries, with car crashes coming in a close second. Unfortunately, when elderly patients do slip and fall and suffer a spinal cord injury, they are 4x more likely to die in the emergency room and 6x more likely to die from complications during their inpatient stay. Spinal cord injuries are not only traumatic for patients, but they are also costly. The National Spinal Cord Injury Statistical Center estimates that spinal cord injury victims will spend between $1 million and $5 million during their lifetime, thanks in large part to improving technology that allows victims to live longer lives. In addition, spinal cord injuries cost the healthcare system more than $5 billion a year. Understanding the costs associated with spinal cord injuries, as well as the complications that can arise after the initial injury is extremely important. Your attorney will need to consider all of these factors when advocating for your rights and ensuring that you receive the compensation you need throughout your life. Spinal cord injury victims will need money to cover all medical expenses, rehabilitation expenses, lost wages, loss of future earnings, pain and suffering, and more. After all, your life may never be the same—you need an attorney who can help you plan for the obstacles you will now face and ensure that your future isn’t jeopardized further. denver personal injury attorneyCar and motorcycle accidents often occur at lightening speeds and with little warning. The impact from those crashes can leave victims with crushed and broken hands, arms, legs, and feet. While orthopedic surgeons and physicians are usually able repair the majority of broken bones and limbs, there are times when complications and even infections can interfere with the healing process. When this occurs, it may be necessary to remove the injured extremity in an attempt to save the accident victim’s life. After an amputation, accident victims will need to relearn even basic skills, such as walking, driving, or even dressing themselves. In addition, they may be unable to continue in their chosen profession, and be forced to find new lines of employment. It is important to understand the true costs of limb loss before you agree to a settlement. These costs are not always apparent and future expenses, such as prosthetic devices, must be taken into account. A study conducted by John Hopkins Center for Injury Research and Policy found that the total lifetime costs of amputation was well over a half million dollars. This included costs such as hospitalizations, prosthetics, rehabilitation, therapies, outpatient doctor visits, and pain medications. It did not, however, take into account lost wages, loss of future earnings, or pain and suffering. Prosthetic Devices are Expensive If you have suffered the loss of a limb, you will need to be fitted for a prosthetic. These artificial hands, arms, and legs can be costly and cost between $5,000 and $50,000 depending on their design and material. In addition, being fitted for a prosthetic means additional rehabilitation to learn how to use the new device. It is important to know that these costs are not a one time only cost either. Prosthetic devices are usually changed out every 3-5 years, and this ongoing cost must be taken into account before reaching an appropriate settlement. The driver arrested in connection with the death of a cyclist in Lyons has publicly criticized bicyclists, according to the Denver Post. As the Lyons Planning and Community Development Commission held town meetings concerning bike lanes on local streets, Patrick Ward occasionally appeared to make comments about cyclists “disobeying signage and traffic lights” as well as saying that “These people don’t belong in Lyons.” Ward was arrested after a traffic accident in which a cyclist was killed. Police believe that he was under the influence of alcohol at the time, and charged him with vehicular homicide, careless driving resulting in death, and DUI.

Every year, about 30,000 people are killed in traffic accidents across the United States, according to the National Highway Traffic Safety Administration. Of those fatalities, between 500 and 1000 are bicyclists. While this number is comparatively low, it is certainly far too high for the hundreds of families that are left to mourn the loss of loved ones. It is extremely important for every cyclist to pay close attention to their surroundings and be constantly aware of traffic. On the other hand, it is also vital that every driver be aware of the possibility of cyclists and pedestrians in the area.

The National Highway Traffic Safety Administration reported that in 2010, over 4,000 pedestrians were killed in pedestrian-car collisions. Over 70,000 pedestrians were injured in 2010. This means that a pedestrian was killed every two hours and injured every eight minutes in traffic crashes in 2010. The most common time for pedestrian-car accidents to occur is during the nighttime, over 68% of pedestrian fatalities occurred at night. Most people are out enjoying the weather on nice days in Colorado. That coincidentally is when over 80% of pedestrian fatalities occurred. Almost three-fourths of pedestrian fatalities occurred in an urban setting versus a rural setting.  This means that the highest chance you have of being in a pedestrian-car accident is when in cities on a clear sunny day. It is important as a pedestrian to decrease your chances of being hit by obeying the pedestrian laws and crossing signals. However, children 15 and young accounted for 7% of the pedestrians killed by motor vehicles. As a driver it is important to always check for pedestrians in blind spots and in crosswalks. There were over 51,000 accidents that involved buses in 2005 according to National Transportation Statistics. The Federal Motor Carrier Safety Administration reported that commercial vehicles accidents accounted for nearly 5,000 fatalities in in 2006.

According to sources at 9news.com, the driver of the 2002 Dodge Ram pickup, 49-year-old William Nale, told authorities that he was unable to see Murphy in the marked crosswalk due to the morning sun. The accident happened in Aurora near Summit Elementary School. Aurora Fire says Murphy was on his way to work at 7:30am when he was struck. Have you or a loved one been seriously injured in an auto crash and have questions concerning your personal rights? Contact a dedicated Colorado bicycle accident lawyer to evaluate your case. According to the National Highway Traffic Safety Administration, several hundred cyclists are killed in traffic accidents every year, and more than one in five deaths is the result of a collision with a vehicle at an intersection. In many cases, the accident occurred because the driver did not see the cyclist. Because cyclists have very little protection, it is important for both the driver, and the cyclist to proceed with caution and pay close attention when entering crossing zones or intersections. Colorado law requires all vehicles to stop for pedestrians at a crosswalk.
