9 News reports that football helmet manufacturer Ridell has been ordered to pay over $3 million to the family of a high school student in Las Animas County who suffered brain injuries while wearing a Ridell helmet. The suit claims that Ridell failed to adequately warn of the dangers of concussion. Ridell faces a similar suit in California, as well as complaint by numerous former NFL players. The jury here in Colorado determined that damages in the case totaled $11.5 million, and that Ridell was 27% responsible for the young man’s injuries. That makes the award in the range of $3.1 million (27% of $11.5 million). The family’s attorney plans to ask the judge to find Ridell responsible for the entire $11.5 million judgment.

crib-safeThe Consumer Product Safety Commission, a government agency charged with ensuring the safety of consumer products available for sale in the United States, offers tips for parents on ensuring the safety of their babies while sleeping in their cribs, or playing in a playpen. While no one would intentionally place their child in a dangerous situation, there are a number of ways that babies can be seriously injured in their cribs. One of the most important tips, and one that is not always obvious to new parents, is to avoid putting pillows or excessive blankets in the crib with the baby. The less objects that are in the crib, the better. Check that the mattress fits correctly, with spaces no bigger than two fingers’ width between the mattress and the sides of the crib. Please make sure that the crib is properly assembled. Do not use cribs older than ten years, and do not use a crib that may be broken or incorrectly assembled. Don’t put the crib near windows with cords from blinds or curtains. If your baby has been seriously injured because of a defective crib or other baby product, contact an experienced Denver products liability attorney today to discuss your options. Babies are curious by nature. One of the principle ways that they learn about the world around them is by investigating anything and everything around them. Putting their hands, feet, and heads through spaces they find, playing with, feeling, or tasting objects that they find, and exploring their environment are not just play for babies, but they are a key part of how they learn and develop. Unfortunately, this sometimes causes trouble. Each year, tens of thousands of babies are treated in emergency departments across the country as the result of cribs and other nursery products. john-fuller-personal-injury-attorneySpeak with dedicated Denver products liability attorney John R. Fuller today if your baby has been seriously injured by a defective crib or other nursery product. Sometimes, injuries suffered during infancy can result in a lifetime of medical treatment. If that need is caused by the negligence of a company that manufactured a defective crib, an experienced Denver products liability attorney can fight to hold that company accountable for their actions. You may be entitled to financial compensation for present and future medical bills as well as pain and suffering if your baby’s life is seriously impacted by the defective product. Liberty Mountain has recalled the Easy Go XP Lock Via Ferrata Lanyards, according to the Consumer Product Safety Commission (CPSC). The lanyard features elastic webbing which, it has been determined, may deteriorate over time, putting climbers at risk of falls that may cause injury or death while using the product. No injuries have been reported, however the potential for serious injury is severe. People who have this product should stop using it immediately, and get in touch with Liberty Mountain for a replacement or refund. The CPSC is a federal agency charged with ensuring the reasonable safety of consumer products in the United States. In most cases, the company whose product is being recalled cooperates with the CPSC, particularly in cases where the potential for serious injury or death is high. Have you or a loved one been seriously injured by a defective consumer product? Contact an experienced Denver product liability attorney today to discuss your options. We hear about product liability lawsuits every day, but many people don’t truly understand what the phrase “product liability” means. In simple terms, companies that manufacture consumer products have a legal responsibility to ensure the reasonable safety of those products. In some cases, and a climbing lanyard is a good example of one, a product may be designed to be used during an activity that carries inherent risk. In other words, anyone could be seriously injured while rock climbing, regardless of the equipment used. In these cases, the manufacturer has to create a product that is reasonably safe when it is used as intended. It also must be reasonably difficult to accidentally use incorrectly. If a defect in design or manufacture, or a failure to warn of potential danger, causes injury or death, then the manufacturer may be liable for the damages suffered by consumers. john-fuller-personal-injury-attorneyCall Denver product liability attorney John Fuller today if you or a family member have been seriously injured by a defective consumer product. While most people probably don’t regularly check the CPSC website, if you have been seriously injured by a product that you believe you were using correctly, John can help you look into whether there was negligence by the manufacture. According to CBS Denver a mother had to cut a seat belt off her child to keep her from strangling to death after the seat belt malfunctioned. The mother strapped her child in the back seat and when she had returned to the car her child was wrapped in two seat belts and was unconscious. The woman had to rush into the nearby school and get a pair of scissors. The mother said that when she had tried to pull the seat belt back to get her child’s head and neck loose but it did not work, but instead the seat belt continued to tighten around the girls neck. According to the news report this is not a rare incident but a common occurrence, common not only among young children but also among older children and teens. Have you been seriously injured by a malfunctioning product that you commonly use? Contact a Denver product liability lawyer to see if you are entitled to financial compensation. The Automotive Safety Program reports seat belt strangulation is not an uncommon occurrence.  It is a common concern among many consumers, the frequency of a recalls for seat belts. Often a redesign of seat belts is suggested to fix this problem permanently. However, car companies believe that to fix this problem it is necessary to teach and educate parents on how to properly monitor children when they are in a vehicle. The ASP finds that what is causing children to become strangled in the safety belts is an interlocking mechanism. This is designed that when a sudden force is placed on the belt it will lock up to prevent a person from being ejected from the seat. However, what is currently happening is that children are pulling on the belt and causing the locking system to engage when the belt is around their neck. Then since it is not the same force of a car accident the belts continue to stay locked and retract the belt. It is this retraction process that is causing the children to strangle as the belt tightens. ASP believes that if parents don’t leave their children unattended in cars and maintained supervision over them that the children would not be able to get themselves in the dangerous situation of a being strangled by safety belts. According to KDVR.com, a crash on Highway 34 near Loveland involving a horse trailer resulted in rescue crews having to use the Jaws of Life to free one of the two horses that were being transported in the trailer. The accident occurred around 5 pm when the trailer became unhitched from the Recreational Vehicle that was pulling it. Apparently no other vehicle was involved in the accident beside the horse trailer, and there was no serious injury to either horse, although the one, which is known for appearing in jousting competitions had to be sedated to be removed from the trailer. Certainly, with a trailer coming unhitched from its vehicle, it is lucky that no one was hurt, and that there wasn’t more property damage. The article does not make clear why the trailer came unhitched. While we obviously don’t know, one possibility is a defective hitch on either the RV or the trailer. Have you or a loved one been injured in an accident caused by defective equipment on a vehicle? Contact a Denver Defective Product Attorney today to discuss your options. Every year, there are well over 5 million police-reported motor vehicle crashes in the United States, according to data provided by the Federal Motor Carrier Safety Administration. The vast majority of them involve property damage only, with no injuries. Of course, the injuries that they report would be injuries to people, not animals. Had the horses been seriously injured or killed, this still would not have been considered an injury accident, but veterinarian bills or replacement cost of horses would have represented a significant amount of property damage. If you have been involved in a car accident that was caused by defective equipment on your car or someone else’s, contact a Denver defective product attorney as soon as possible to protect your legal rights. A 2-year-old boy is in critical condition after being struck by a truck in a Colorado Springs car wash parking lot. 7News is reporting that the boy was with his father at the car wash on South Academy Blvd when he was struck by a Hummer on Tuesday. Police said the boy was taken to the hospital with a serious head injury. A small plane tried to take off from Centennial Airport on Monday, only one problem, there was no pilot. According to Denver Channel 7, 73-year-old Richard Steinmier was having trouble starting his Cessna from the cockpit due to a dead battery. He tried to start the plane manually by turning the propeller. The plane started and began to taxi down the runway by itself. Steinmier sustained minor injuries as he tried to climb into the plane as it was moving. The plane traveled about 1,000 feet on its own before flipping over. The pilot was the only person reported to have sustained injuries in the accident. The Denver Post reported earlier this month that a pilot was forced to make an emergency landing outside of Loveland. The engine in the experimental aircraft he was flying exploded in mid-flight causing the aircraft to lose its wings. The pilot was able to land the plane safely and avoid injury. Though plane accidents are rare, they do occur. According to the most recent NTSB statistics, there were 79 general aviation accidents in 2009 resulting in 38 fatalities. Accidents can happen in an instant. Aviation accidents can be very serious for both passengers and people on the ground.
