Truck Driver Fatigue is a Dangerous Problem The trucking accident last year which killed comedian James McNair and critically injured comedian Tracy Morgan has brought safety concerns about the trucking industry to the forefront. In particular, the subject of truck driver fatigue, which can result in serious or fatal collisions, must be looked at closely. In June 2014, a Walmart truck slammed into the limousine van Tracy Morgan and six other passengers were riding in. Reportedly, the truck driver had not slept in at least 28 hours. According to Keith Holloway, a spokesman for the NTSB, fatigue has been seen repeatedly in truck crashes. Holloway says while “it (fatigue) is not the sole cause of truck crashes, it is one of the leading causes…”
Denver car accident attorney If you are involved in a car accident with one other vehicle, establishing fault is usually a matter of deciding if you or the other driver is to blame for the accident. Occasionally, there may be a third party responsible, such as a government entity or construction road crew. When the accident involves multiple vehicles, however, establishing fault can become increasingly difficult. Multi-vehicle crashes or pileups usually result from a chain reaction. In most multi-vehicle accidents, there may be multiple parties to blame for different components of the accident. You yourself may share some of the blame for the accident or for a portion of the pileup. With so many differing points of view, it can be difficult to establish negligence and know which insurance company to contact. To make matters worse, insurance companies understand these complications and are usually reluctant to reach settlements until the chain of negligence is fully established. To further complicate matters, passengers in varying vehicles may be seeking compensation from all parties responsible or from the driver of the very vehicle they were riding in. As such, you may find yourself seeking compensation from other drivers’ insurance companies and defending yourself from lawsuits at the same time. The complexities that surround multi-vehicle crashes are endless and require a law firm with the resources to fight aggressively for your rights. Insurance companies do not usually reach settlements quickly when there are multiple parties involved and everyone begins pointing fingers at everyone else, in an attempt to reduce their own liabilities. When significant injuries or deaths are involved, the complications become even greater, with much more at stake. Injured accident victims or families who have lost a loved one will need money for medical expenses, lost wages, lost future earnings, pain and suffering, and more. Choosing a lawyer who understands the complications that can arise in a multi-vehicle crash is important to obtaining the compensation you need—and deserve. denver personal injury attorneyCar and motorcycle accidents often occur at lightening speeds and with little warning. The impact from those crashes can leave victims with crushed and broken hands, arms, legs, and feet. While orthopedic surgeons and physicians are usually able repair the majority of broken bones and limbs, there are times when complications and even infections can interfere with the healing process. When this occurs, it may be necessary to remove the injured extremity in an attempt to save the accident victim’s life. After an amputation, accident victims will need to relearn even basic skills, such as walking, driving, or even dressing themselves. In addition, they may be unable to continue in their chosen profession, and be forced to find new lines of employment. It is important to understand the true costs of limb loss before you agree to a settlement. These costs are not always apparent and future expenses, such as prosthetic devices, must be taken into account. A study conducted by John Hopkins Center for Injury Research and Policy found that the total lifetime costs of amputation was well over a half million dollars. This included costs such as hospitalizations, prosthetics, rehabilitation, therapies, outpatient doctor visits, and pain medications. It did not, however, take into account lost wages, loss of future earnings, or pain and suffering. Prosthetic Devices are Expensive If you have suffered the loss of a limb, you will need to be fitted for a prosthetic. These artificial hands, arms, and legs can be costly and cost between $5,000 and $50,000 depending on their design and material. In addition, being fitted for a prosthetic means additional rehabilitation to learn how to use the new device. It is important to know that these costs are not a one time only cost either. Prosthetic devices are usually changed out every 3-5 years, and this ongoing cost must be taken into account before reaching an appropriate settlement. If you or a loved one has been injured in a Denver trucking accident, you may be wondering what steps to take next. Is there anything I can do to get compensation for lost time at work or money spent out of pocket for medical expenses? Can I file a lawsuit against the trucking company for negligence? Sometimes, in truck accidents, the negligence of the trucking company that employs the truck driver or owns the truck may be a contributing factor in the accident. When this happens, injured parties may be eligible to receive compensation for their injuries, medical bills, property damage, lost wages and mental anguish by filing a truck accident lawsuit against the negligent trucking company. Some specific examples of trucking company negligence may include; Failure to conduct background checks on drivers before allowing them on the roadways Failure to properly maintain trucks Establishment of unrealistic driver schedules When trucking companies fail to perform adequate background checks on drivers, neglect their responsibility to maintain their trucking fleet, or place profit before safety by placing unrealistic expectations on their drivers, they are neglecting their obligation to public safety and should be held accountable for the harm they cause. Truck accidents in Denver are different than other vehicle accidents because of the federal laws that govern the trucking industry, and an experienced Denver trucking accident attorney will know exactly where to begin. There are several things that need to happen immediately to help build the best case possible for you, the victim. It is imperative that all evidence is preserved and witnesses are interviewed. Accident reconstruction specialists may be needed to inspect the crash vehicles and look for evidence of the impact and any defective parts. It is important to understand that investigating a truck accident can be very expensive. A qualified Denver truck accident lawyer will have the resources to investigate and win your case for compensation of personal injury or wrongful death. Truck accident lawsuits can also be complicated because in many cases, more than one insurance company is involved. It is the trucking company’s insurance company that will ultimately pay the truck accident victim and his or her family. If you have been involved in a truck accident in Denver, the trucking firm’s insurance company will most likely contact you. DO NOT speak with them, their goal is to make sure they pay out as little as possible. Instead, contact a law firm with experience handling truck accident lawsuits. Act quickly to preserve your rights. According to KDVR.com, Shawn Howell witnessed an accident this morning in which a trash collection truck rolled over onto a Jeep, causing significant damage to both the truck and the Jeep. Mr. Howell said that both vehicles were driving the same direction on Colorado when they came to another accident. In trying to avoid the other accident, the garbage truck rolled onto the Jeep. Shortly after the accident, an employee of Law Father who was on his way to work passed the accident site. He stopped to help, and took some pictures as workers returned the trash truck to its wheels. Have you or a loved one been injured in a commercial vehicle accident? According to the Denver Post, a 19 year-old man has died after being hit by an out of control landscaping truck on May 20th. The young Denver man was sitting with his friend on a playground bench in Jefferson County, when the driver of the landscaping truck lost control of his truck and struck the bench. According to the Colorado State Patrol, the truck driver failed to complete a left turn and ran off the road and into the unfortunate young man. At this time charges have not been filed. Even when driven by professional truck drivers, these large, heavy trucks also carry a risk of causing trucking accidents, which can lead to catastrophic injuries. Denver truck accident attorneys have long advocated for better, more consistent truck-safety enforcement measures to reduce the number and seriousness of such crashes, yet much work remains to be done. A truck driver from Texas, Richard E. Widmier, “will be sentenced Nov.12 in the deaths of Ginger M. Gillespie, 48, and Lois A. Kelton, 77, according to a news release from the 18th Judicial District.” According to an article from The Denver Post, Widmier was not suspected of driving under the influence but was driving too fast for road conditions on the day of the accident. The accident took place on I-70 west of Limon during an April 2009 blizzard.  Both victims died at the scene of the accident. Widmier pled guilty to two counts of vehicular homicide. The National Highway Traffic Safety Administration reports that nearly 27,000 people died in 2008 motor vehicle accidents. That averages to 3 deaths every hour and 73 motor vehicle related deaths every day. The NHTSA reports that the total number of deaths on US roads has decreased in the past two years, which may be attributed, in part, to the slow economy as well as to an increase in efforts by local law enforcement to crack down on drunk driving. A tractor-trailer crash on I-70 Monday night has resulted in the driver being arrested for suspicion of drunk driving.  According to 9News, the tractor-trailer was traveling westbound Monday night with a trailer loaded with beer when the semi went off the road, hit the median and rolled onto its side. The driver of the semi was not injured but the semi caught fire after the crash. In Colorado, DUI and impaired offenses are misdemeanors; injury-related DUI offenses are class 4 felonies. According to Alcoholalert.Com, between 2000 and 2008 there were 5,703 total traffic fatalities in the state of Colorado with 2,267 of those fatalities being alcohol related. The simple act of drinking and driving is considered by many to be one of the most dangerous combinations an average individual can make. Alcohol impairs a person’s judgment, slows their reaction time, and generally detriments any person’s ability to drive. Drinking and driving is responsible for many accidents in Colorado each year and drunk driving is listed as one of the leading causes of automobile fatalities for the state. Driving after drinking is not only a bad decision; it can also be a deadly one. If you have been injured in a drunken driving accident or if you have a loved one who has been injured or killed by a drunk driver, help is available.
