Trucking and Drug Use

Aurora and Denver Trucking Accident Injury Attorney

Large commercial truck drivers are often required to drive for long extended periods of time. Even though the FMCSA (Federal Motor Carrier Safety Administration) has strict regulations regarding the amount of time a driver is legally allowed to drive, many drivers and trucking companies routinely break these rules and put everyone in danger. As a result, many truck drivers turn to over the counter drugs, prescription drugs and even illegal drugs to stay awake or get high. Trucking companies are required to perform random drug testing on all of their truck drivers. Yet studies have found that up to 75% of the drug testing sites were non compliant with the rules needed to adequately perform these tests. In other words, they failed to supervise the testing and allowed drivers access to substances that had the ability to make the drug tests invalid. When the FMCSA performed a 3 year trucking accident causation study to determine why trucking accidents were taking place, the results were astonishing. According to the study, 26.3% of all trucking accidents were caused by prescription drug use. Comparably, over the counter drug use accounted for 17.3% and illegal drug use only 2.3%. Even though many trucking companies routinely screen for illegal substances, truck drivers were unfortunately abusing OTC and prescription drugs instead. These drugs are not able to be detected by a typical drug test, yet their presence in the blood can have significant effects on a truck driver’s ability to drive safely. If you or someone you love was injured in a trucking accident, it is important to contact a Colorado trucking accident attorney immediately. Your attorney will need to investigate your case carefully to determine if drug abuse or misuse contributed to your accident and caused your injuries. If the truck driver is found negligent, you may be entitled to receive compensation for medical expenses, rehabilitation and other damages. Colorado Car Accident Law Firm
