In Colorado, all motorists are required by law to carry motor vehicle insurance. Required insurance minimums are as follows:$25,000 per person for bodily injury;$50,000 per accident for bodily injury; and $15,000 per accident for property damage. Unlike individuals in many other states, individuals in Colorado are not required to carry uninsured motorist insurance by law. Uninsured motorist insurance is available for everyone but most people choose to decline uninsured motorist coverage to keep their total premium amounts low. Unfortunately, if an individual is in an accident with an uninsured motorist and they don’t have uninsured motorist insurance, the individual will be left paying all costs out of pocket.
The minimum insurance coverage in Colorado is rather low compared to the ballooning cost of medical treatment. In cases where significant medical treatment is necessary, the cost may exceed the maximum amount covered by an individual’s insurance. So even when another driver is responsible for your injuries in a car accident, if the total cost of your treatment exceeds their coverage limits, you are left paying the difference out of pocket.
There is however an alternative to shouldering the full financial burden when you are involved in an accident with an uninsured motorist. You can file suit against the uninsured driver who was responsible for the accident which you were involved in. This requires the help of an attorney and is often a person’s only chance to receive any compensation for injuries sustained in an accident with an uninsured motorist if that individual does not have an uninsured motorist policy. Filing suit may also be the only option available to an person who’s medical expenses exceed the coverage limit of the responsible parties insurance.
